COOKIE POLICYOn May 8, 2014, the Italian Privacy Authority announced the regulation for identifying simplified methods for information and obtaining consent for the use of cookies; this document was converted into state law, Cookie Law, on June 3, 2014 (see also Privacy Authority, no to profiling cookies without consent).
With this law, the owner/manager of the website is required to obtain the prior and informed consent of users for the installation of cookies used for purposes other than purely technical ones.
WHAT ARE COOKIES Cookies are text files containing minimal information sent to the browser and stored on the user’s computer, phone, or other device, every time a website is visited. Each connection sends cookies back to the referring site.
Cookies can be permanent (persistent cookies) if they remain on the computer until the user deletes them, or temporary (session cookies) if they are disabled when the browser is closed. Cookies can also be first-party cookies if set by the visited site, or third-party cookies if inserted by a site other than the one visited.
For the purposes of the legislative measure, the Privacy Authority identifies two types of cookies: “technical cookies” and “profiling cookies.”
Technical Cookies Technical cookies are those used solely to “carry out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service” (see art. 122, paragraph 1, of the Privacy Code). They are not used for additional purposes and are normally installed directly by the website owner or manager. They can be divided into navigation or session cookies, which guarantee normal navigation and use of the website (allowing, for example, to make a purchase or authenticate to access restricted areas); any analytics cookies, assimilated to technical cookies when used directly by the site manager to collect information, in aggregate form, on the number of users and how they visit the site itself; functionality cookies, which allow the user to navigate according to a set of selected criteria (for example, language, products selected for purchase) to improve the service rendered to the same. The prior consent of users is not required for the installation of these cookies.
Profiling Cookies Profiling cookies are aimed at creating user profiles and are used to send advertising messages in line with the preferences expressed by the user while browsing the web. Due to the particular invasiveness that such devices can have in the private sphere of users, European and Italian legislation provides that the user must be adequately informed about their use and thus express valid consent. They refer to art. 122 of the Privacy Code where it provides that “the storage of information in the terminal equipment of a contractor or user or access to information already stored is only permitted on condition that the contractor or user has given their consent after being informed with the simplified methods referred to in Article 13 of the Privacy Code, paragraph 3.”

Other third-party cookies When visiting a website, cookies can be received both from the visited site (“proprietary”), and from sites managed by other organizations (“third parties”).
